The current status of this class action settlement is that a decision to grant final approval of the settlement is pending before the Court. With the expiration of the claims submission period, on May 30, 2008, the Settlement Administrator has commenced the process of auditing and validating claims. Please be advised that any claims postmarked or faxed after May 30, 2008 will be considered late. Also, any changes to your address or contact information should be sent in writing to the Settlement Administrator. The issuance of refund checks for valid timely claims will not commence until after the Court enters an order granting final approval of the settlement, any potential appeals are resolved, and the Settlement Administrator has validated the claims. The United States District Court has approved changes to the settlement claims procedures described on this website. Among other things, the changes include revised claim forms for individual claims. The new claims procedures permit individual class members to choose to make claims without the need to review their own records of their foreign transactions. The claim form for company/agency claims will remain the same. If you previously submitted a claim form for your individual claims, you do not have to file a new claim form, but you may submit a new one under the revised procedures if you wish.

In addition, the deadline for filing a claim has been extended to May 30, 2008, and the deadline for opting out of the settlement damages class or objecting to the settlement has been extended to February 14, 2008. The hearing for final approval of the settlement is scheduled for March 31, 2008 at 11:00 a.m. at the U.S. District Court for the Southern District of New York, 500 Pearl Street, New York, N.Y. 10007-1581.
